Using Other People's Photos and Viral Clips in AI Videos: Consent, Rights and Safety

Can you put a friend, a parent or a celebrity in an AI trend video? A plain guide to consent, music rights, platform AI labels and photo privacy.

AI trend videos are meant to be fun, and most of the time they are. But they put a real person's face into a scene they never filmed, set to music and footage someone else owns. A few simple rules keep it fun for everyone involved. This is a plain-language guide, not legal advice.

Rule 1: Ask before you put someone in a video

The person in your photo should know and agree, especially before you post it. Putting a friend into the Burning Bridges toast for their birthday is a nice surprise to share with them. Posting a video of a coworker without asking is a different thing, even if it's meant as a joke.

Our rules are simple:

  • Upload photos of yourself, or of adults who have agreed.
  • Never upload photos of children. Several of the trends involve dancing, partying or fashion, and a child's face doesn't belong in those scenes.
  • No public figures or celebrities dressed up as endorsing something, and nothing designed to mislead people into thinking a video is real.

Rule 2: Know what you do and don't own

A trend video mixes three things:

PartWho owns it
Your face and your photoYou (or the person in it)
The songThe artist, label and publishers
The original clip or sceneThe person or company who filmed it

Generating a video doesn't give you rights to the music or the original footage. Sharing trend videos on your personal social accounts is how these trends spread, and platforms have licensing deals for many songs. Commercial use is different: ads, brand accounts or paid promotion can infringe the music and clip owners' rights. If you want to use a trend for a business, get proper licences or make an original version.

Rule 3: Label AI content

TikTok, Instagram and YouTube all ask you to disclose realistic AI-generated content and give you a label for it when posting. Use it. It keeps your account in good standing, and it makes clear the video is a playful edit, not a real recording, which matters most when it shows a real person.

Rule 4: Don't use it to embarrass or deceive

Fine: a friend scoring a famous goal, your dog driving a rocket car, a couple dancing a duet.

Not fine: putting someone in a scene to humiliate them, making a video that could pass as real evidence of something they didn't do, or anything sexual, hateful or harassing. Generations that break these rules can be refused or removed.

What happens to the photos you upload here

Because the whole thing depends on trust, here's exactly how photos are handled on AI Effect Studio:

  • Photos are stored privately and used only to generate the video you asked for.
  • They're sent to our video generation provider for that job only. For effects with a soundtrack, the generated video (not your original photo) is sent to our audio provider to add the sound.
  • Photos are deleted after 7 days. Finished videos are deleted after 30 days, or sooner if you delete them in My videos.
  • Videos are visible only to your account; there's no public gallery of user uploads.
  • We don't send your photos, videos or name to analytics.

The full details are in our privacy policy and terms.

If someone used your photo

If you find a video of you made on this site without your consent, email support@aieffectstudio.com with a link or description and we'll look into it. On social platforms, use the platform's report tools for impersonation or AI content made without consent.

The short version

  • Your face, or a consenting adult's. Never a child's.
  • Personal sharing is the norm; commercial use needs licences.
  • Turn on the AI label.
  • Keep it kind.

Common questions

Can I make a video of a celebrity? Don't. Using a public figure's face can mislead people and can break platform rules on impersonation.

Is a deceased relative's photo allowed? It's a personal decision; please consider how the rest of the family would feel. The usual rules about respectful use apply.

Do you use my photos to train AI? We don't. Photos are sent to our video provider only to make the video you asked for, and we delete them from our storage after 7 days.

Can I delete my account and data? Yes, from Settings. You can also delete individual videos in My videos at any time.
